This Privacy Policy encompasses Harbaugh Coaching Academy, Inc. and its direct and indirect subsidiaries, collectively referred to in this policy document as “HCA,” “we,” or “company.” This Privacy Policy describes how HCA collects, uses, processes, shares, and protects Users’ Personal Data gathered through our business operations and on our websites (the “Services”). It also tells you about your rights and choices with respect to your information and how you can contact us if you have any questions or concerns.

01 PERSONAL DATA COLLECTED

For the purposes of this Privacy Policy, “Personal Data” means any information relating to an identified or identifiable individual who uses or participates in the Services (the “User”, or “you”). HCA obtains Personal Data relating to you from various sources described below. If you do not provide Personal Data when requested, you may not be able to benefit from the Services, if that information is necessary to provide you with the Services or if HCA is legally required to collect it.

PERSONAL INFORMATION WE COLLECT

When you visit our website, you automatically provide us with certain Personal Data, including information about your web browser, IP address, time zone, and some of the cookies (if any) that are installed on your device. We refer to this automatically collected information as “Device Information.”

Additionally, in using the Services you will also provide us with your first name, last name, email address, and zip code. Additionally, as you browse HCA’s websites, we collect information about the individual web pages or services that you view, what websites or search terms referred you to HCA and information about how you interact with HCA (“Form Information”).

Users may provide Personal Data in HCA’s publicly accessible social media platforms. Users should be aware that any information provided in these areas may be read, collected, and used by other Users who access the social media platforms.

Device Information is collected by HCA and HCA’s third party service providers through:

  • “Web beacons,” cookies, pixels, tags, and other tracking technologies which ensure that our Services function properly and to allow us to give users a more personalized experience. Cookies can be “first party cookies” (served by us) or “third party cookies” (served by others).
  • “Log files” which are used to track actions occurring on the HCA website, and collect data including your IP address, browser type, device IDs and characteristics, country code or approximate location, operating system version, language preferences, Internet service provider, referring/exit pages, and date/time stamps.
  • Page tags which are used to determine how users interact with our website.

By using the Services, you consent to the placement of cookies, beacons, and similar technologies in your browser and on emails in accordance with this Privacy Policy. We may use this information, for example, to ensure that the Services function properly, to determine how many Users have visited certain pages or opened messages or newsletters, or to prevent fraud. We work with analytics providers such as Google Analytics, which use cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends. These services may also collect information regarding the use of other websites, apps, and online resources. We also work with third party advertisers (collectively, “Advertisers”) who may also use cookies or other technologies to track your use of the Services. Advertisers also may use cookies to track your online activities across websites over time to provide interest-based advertising, which includes targeted advertisements or marketing communications we believe may be of interest to you. If you do not want information collected through the use of cookies, most browsers allow you to automatically decline cookies or be given the choice of declining or accepting the transfer to your computer of a particular cookie (or cookies) from a particular site. The HCA website may include social media features and other widgets. HCA may link its website to its profiles on social media platforms including, but not limited to, X (formerly known as Twitter), Facebook, and LinkedIn. These features may collect a user’s IP address, which page being visited on the site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on the HCA site. A user’s interactions with these features are governed by the privacy policy of the company providing it.

HCA uses Local Storage Objects (LSOs) such as hypertext markup language (HTML) 5 to store content and preferences. Third parties with whom we partner to provide certain features on our site or to display advertising based upon your web browsing activity use LSOs such as HTML 5 to collect and store information. Various browsers may offer their own management tools for removing HTML 5 LSOs.

INFORMATION COLLECTED VIA THIRD PARTIES

We may also obtain information, including Personal Data, from third parties and sources other than the above. This information may come from analytics providers (such as Google Analytics).

02 HOW DO WE USE YOUR PERSONAL INFORMATION?

The Personal Data (which includes both Form Data and Device Data) that Users provide to HCA may be used to:

  • Operate, provide, and maintain the Services
  • Evaluate the quality of HCA products
  • Provide Users with information about services that may be of interest
  • Communications: HCA may:
    • ask Users for contact details, which may include name, phone number, email address, when downloading or viewing marketing related materials, including without limitation whitepapers and webinars.
    • send emails to an email address you provide to us (i) for customer service or technical support purposes or to respond to User questions and comments; or (ii) to send you information about topics or content that we think may interest you or updates about the latest developments or features on the site; or
    • call you, if you have not objected or provided any indication to the contrary, on a contact number that you have provided to us or that we have received from third parties as part of our telemarketing campaigns or outreach programs.
  • Deliver or provide products or Services to the User
  • Respond to User requests
  • Provide access to Internet or application-based activities
  • Monitor and analyze usage of the Services and improve and enhance the Services
  • To enforce the HCA Terms of Service, to defend our legal rights, to comply with our legal obligations and internal policies.
  • We may de-identify and aggregate information collected through the Services for statistical analysis and other lawful purposes.

If you receive commercial electronic communications from us, you can unsubscribe from the receipt of future commercial electronic communications from us by clicking on the “unsubscribe link” provided in such communications.

You may also opt out from receiving commercial emails from us by sending your request to us by email at contact@harbaughcoachingacademy.org. Please be aware that, even after you opt out from receiving commercial messages from us, you may continue to receive administrative messages from us regarding the Services.

Your Data Protection Rights (EEA)

In certain jurisdictions you have the right to request access and receive information about the Personal Data HCA maintains about you, to update and correct inaccuracies in your Personal Data, to restrict or object to the processing of your Personal Data, to have the information blocked, anonymized or deleted, as appropriate, or to exercise your right to data portability to easily transfer your Personal Data to another company. Those rights may be limited in some circumstances by local law requirements. In addition to the above-mentioned rights, you also have the right to lodge a complaint with a competent supervisory authority subject to applicable law.

To update your preferences, ask us to remove your information from our mailing lists, delete your account or submit a request to exercise your rights under applicable law, please contact us as specified in the “Contact Us” section below.

03 SHARING YOUR PERSONAL INFORMATION

HCA discloses information that we collect through the Services to third parties in the following circumstances:

  • HCA does not sell Personal Data.
  • To our third party service providers who provide services such as website hosting, data analysis, information technology and related infrastructure provision, customer service, email delivery, online advertising, auditing, and other services.
  • HCA may use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you. For more information about our advertising and marketing practices and those of the third party advertising partners, please see the Personal Data Collected via Automated Means section above.
  • HCA may also disclose your Personal Data with your permission. We may seek your permission in various ways. For example, we may present you with an “opt-in” prompt when you register to use the Services or access certain content.
  • HCA may share Personal Data across its direct and indirect subsidiaries and other related entities.
  • If required to do so by law or in the good faith belief that such action is appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (d) to enforce our terms and conditions; (e) to protect our operations or those of any of our affiliates; (f) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain. We may use and disclose aggregate information that does not identify or otherwise relate to an individual for any purpose.

04 RETENTION

HCA will retain and use Personal Data as necessary to comply with legal obligations, resolve disputes, and enforce agreements. When determining the retention period, we take into account various criteria, such as the type of Services provided to the User, the nature and length of our relationship with the User, the impact on the services we provide to the User if we delete certain Personal Data, mandatory retention periods provided by law, and any applicable statute of limitations. . If users wish to request that HCA no longer use Personal Data to provide Services, contact HCA at contact@harbaughcoachingacademy.org.

The HCA website contains links to other sites that are not owned or controlled by HCA, including social media platforms. Users should be aware that HCA is not responsible for the privacy practices of such other sites. HCA encourages users to be aware when leaving HCA’s site, and to read the privacy statements of each and every website that collects Personal Data.

05 SECURITY

While HCA collects very little personal information about you, HCA takes reasonable precautions to protect Personal Data from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee its security when transmitted to our site or through Services. Any transmission of Personal Data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the site or HCA’s other systems used for our Services.

06 YOUR RIGHTS AND CHOICES

If you decide at any time that you no longer wish to receive marketing communications from HCA, please follow the unsubscribe instructions provided in any of the communications. You may also opt out from receiving commercial email from us by sending your request to us by email at contact@harbaughcoachingacademy.org. Please be aware that, even after you opt out from receiving commercial messages from us, you may continue to receive administrative messages from us regarding the Services.

07 USE OF THE SERVICES BY CHILDREN

The HCA site is not directed to individuals under the age of sixteen (16). We do not knowingly collect Personal Data for persons under the age of sixteen (16) through our Services and we request that they not provide such Personal Data through the our Services. If we learn we have collected or received personal information from a child under 16, we will delete that information. If a parent or guardian becomes aware that their child has provided us with Personal Data, they should contact us at contact@harbaughcoachingacademy.org, and we will take steps to immediately delete that information.

08 YOUR STATE PRIVACY RIGHTS

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.

California, Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

  • Confirm whether we process their Personal Data.
  • Access and delete certain Personal data.
  • Data portability.
  • Opt-out of personal data processing for targeted advertising and sales.

California, Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information’s nature and processing purpose.
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

To exercise any of these rights please email your request to contact@harbaughcoachingacademy.org. To appeal a decision regarding a consumer rights request please email contact@harbaughcoachingacademy.org and indicate “Appeal” in the subject line.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request to this designated address: contact@harbaughcoachingacademy.org. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

If you are a California resident, who under the California Consumer Privacy Act (CCPA) wishes to exercise your rights to your Personal Data, you may submit a Data Subject Request by submitting a request to this designated address: contact@ harbaughcoachingacademy.org. Additionally, if you wish to exercise your right to the sale of data under the CCPA, please submit a request to this designated address: contact@ harbaughcoachingacademy.org and include “Do Not Sell” as the request type.

09 CHANGES

We may make changes to this Privacy Policy. The “Last Updated” date at the top of the policy indicates when this Privacy Policy was last revised. We encourage you to read this Privacy Policy periodically to stay up-to-date about our privacy practices. Your continued use of the Services following these changes means that you accept the revised Privacy Policy.
